For the purposes of these Terms and Conditions, the following terms shall have the meanings set forth below, unless the context otherwise requires:
Application / Platform: Ehtiyajkom Application.
User: Any natural or legal person using the Application.
Service Provider / Seller: Any natural or legal person offering services or products through the Application.
Courier / Delegate: An independent person providing delivery or execution services.
Order / Booking: Any purchase or booking made through the Application.
Ehtiyajkom operates as an electronic intermediary platform that facilitates and organizes orders and bookings and connects users with service providers or sellers.
The Application is not a seller, service provider, owner, operator, or supplier of any products or services.
Full responsibility for the execution of services or delivery of products rests with the service provider or courier.
The Application bears no responsibility for the quality, safety, legality, or suitability of any services or products provided by third parties.
Users must provide accurate, complete, and up-to-date information.
Users are solely responsible for maintaining the confidentiality of their account credentials.
The Application reserves the right to suspend or terminate any account in cases of misuse, provision of false information, or violation of these Terms or applicable laws.
The Application charges service fees (commissions) for the use of the platform and the management of orders and bookings.
Fee amounts or percentages are displayed within the Application.
The Application reserves the right to amend fees, commissions, or calculation mechanisms at any time, including but not limited to:
Adjusting percentages or fixed amounts
Varying fees based on service type, activity, region, or payment method
Applying additional fees for optional services
Any amendments shall be communicated through the Application or other appropriate means and shall apply only to new orders after the effective date.
All payments are processed through licensed and approved electronic payment gateways within the Kingdom of Saudi Arabia.
The Application does not store or process users’ bank card details.
Funds are distributed between the Application and service providers in accordance with the approved settlement mechanisms.
Before order confirmation: The full amount shall be refunded.
After order confirmation:
Refunds are subject to the service provider’s refund policy
Application service fees are non-refundable
Refunds are processed through the original payment gateway.
The Application does not guarantee the availability of any service, facility, or appointment, as availability depends solely on the service provider.
Service providers and couriers are independent contractors.
They are not employees, agents, or representatives of the Application.
The Application does not own or operate any delivery fleet.
The Application is not a party to any contractual relationship between users and service providers or couriers.
The Application shall not be liable for any breach, loss, or damage arising from their acts or omissions, unless directly caused by proven negligence of the Application.
Payments are collected and held temporarily for settlement purposes.
Provider and courier payouts are processed within 3 to 7 business days after successful payment collection.
Settlement timelines may be affected by payment gateway or banking procedures.
Amounts subject to disputes or refunds shall be suspended until resolution.
The Application bears no financial liability prior to successful payment collection unless caused by its own negligence.
The Application’s total liability, if any, shall be strictly limited to the amount of the Application’s service fee related to the disputed order.
Any use of the Application for illegal or unauthorized purposes is strictly prohibited, and the Application reserves the right to take all necessary legal actions.
The Application shall not be liable for any delay or failure in performance resulting from circumstances beyond its reasonable control.
All intellectual property rights, trademarks, content, and materials available on the Application are owned by Ehtiyajkom and may not be used without prior written consent.
Notifications sent via the Application, SMS, or email shall be deemed official and legally valid communications.
The Application reserves the right to temporarily suspend services for maintenance, upgrades, or technical reasons without liability.
These Terms and Conditions shall be governed by and construed in accordance with the laws and regulations of the Kingdom of Saudi Arabia, and the competent Saudi courts shall have exclusive jurisdiction.
These Terms are drafted in Arabic. In the event of any discrepancy between the Arabic version and any translation, the Arabic version shall prevail.
The Application reserves the right to amend these Terms and Conditions at any time, with notice provided to users through the Application.
By using the Application or completing any transaction, the user acknowledges and agrees to be fully bound by these Terms and Conditions.
Service providers and couriers are fully responsible for the accuracy of all content displayed on the Application, including images, prices, descriptions, and schedules.
Service providers warrant that all products and services offered:
Are not prohibited under Saudi laws
Comply with all applicable regulations
The Application bears no liability for such content unless damage results from its direct negligence.
Ratings and reviews represent the personal opinions of users.
Users bear full legal responsibility for the content of their reviews.
The Application reserves the right to remove any review that is abusive, misleading, false, or violates applicable laws, without any liability.
The towing service provider confirms that it is duly licensed to provide vehicle transport services.
The service provider bears full responsibility for:
Vehicle safety during transport
Compliance with prices and schedules
Any damages, violations, or claims arising from the service
The Application’s role is strictly limited to coordination and mediation.
The water provider must obtain all required licenses from competent authorities.
The provider bears full responsibility for water quality, safety, and classification.
The Application does not guarantee compliance with health or environmental standards and bears no liability for any health, material, or legal damages.
Any complaints or claims must be directed solely to the service provider.
The Application acts solely as an electronic intermediary.
The Application is not an owner, operator, or investor in any chalet or rest house.
Service providers must comply with all licensing requirements and regulations issued by the Ministry of Tourism and relevant authorities.
Service providers bear full responsibility for accommodation quality, safety, cleanliness, and regulatory compliance.
The Application disclaims any liability for regulatory violations or material, moral, or health-related damages arising from the stay or use of the facility.
